Ultimately, a Magistrate reviewed the criminal matter and decided that it was appropriate for our client to participate in the diversion program. A diversion plan was formulated with the sole condition that he complete a men’s behaviour change program.

The Family Violence Liaison Officer spoke with our client’s wife at court to confirm her view about the intervention order and ultimately agreed to withdraw the application against our client.

Our client was very appreciative of the opportunity to avoid a criminal record as he works in a professional environment, and any entry on his criminal history would likely result in termination. Furthermore, our client and his wife were grateful that the application for an intervention order was withdrawn, and they could return to their lives together as they were before the incident.

Our solicitor appeared at court for the diversion hearing and made submissions on behalf of the client. Following the submissions, the Magistrate granted the client an opportunity to enter into a six-month diversion plan with specific conditions.

This was the client’s first court appearance for driving charges. He had no prior involvement in the criminal justice system. The Magistrate, therefore, sentenced the client to a $1,200 financial penalty. Despite the serious nature of the offences, the Magistrate did not record a criminal conviction.

Our solicitor made submissions regarding the client’s need for a driver’s licence for his employment. The Magistrate was prepared to reduce the suspension period for charge three to six months from the plea date.

The client was ecstatic with the outcome.

The Magistrate agreed that, in this particular case, ‘special circumstances’ existed, as the client did not intentionally try to avoid paying the fines but was somewhat unaware of them and their accrual. Our client was effectively discharged of her obligation to pay the full debt amount of $33,000. The Magistrate discharged the debt in full. This was an excellent result for the client.

The prosecution reviewed the footage and agreed with our position, withdrawing all charges against our client. This was a fantastic outcome for the client as he avoided criminal proceedings and any finding of guilt.
