Cultivate Commercial Quantity of Cannabis
Facts
The client and the co-accused were caught in a grow house tending to 90 kilos of cannabis plants. The client was charged with Cultivating a Commercial Quantity of Cannabis and, after pleading guilty at the County Court, received a wholly suspended sentence. This in itself was an excellent outcome.
Following the guilty plea, the Crown then made application to seize the client’s house and car under the Assets Confiscation legislation.This was something that we expected.
Result
After numerous consultations, conferences with a specialist barrister in the field and the submission of very lengthy documentation to the Crown and the Court by way of affidavit, the Crown finally withdrew their application. The client was able to keep his house and his car.
