The Court:
County Court of Victoria
The Charges
The Allegations
A duty solicitor had initially appeared for the client at the Magistrates’ Court, and unfortunately for the client, the outcome did not go in his favour. At the time the case proceeded, the client was on bail for other drug trafficking matters, and upon entering a plea of guilty to the new matters, he was sentenced to nine months’ imprisonment.
At Court
This was an awful outcome for the client, and he therefore engaged our office to seek advice regarding an appeal. Upon being retained, our solicitor immediately appealed to the County Court and made a bail application. Following that application, the client was released on bail.
The appeal was listed for a future date, and by the time it came before the County Court, the first matter had been withdrawn.
The Outcome
Before the matter proceeded to appeal, the client was in a live-in rehabilitation facility. When the matter came before the County Court, our solicitor made lengthy submissions. The Judge imposed a work-only Community Correction Order for 15 months, with a requirement of 200 hours of community service. It was an outstanding outcome.
