Drug Trafficking Sentence appealed to County Court
Case Example of Appeal
A duty solicitor had initially appeared for the client at the Magistrates’ Court and unfortunately for the client, things did not go his way. At the time the case proceeded the client was on bail for other drug trafficking matters, and upon entering a plea of guilty to the new matters, he was sentenced to nine months imprisonment.
This was a very bad outcome and we were engaged to assist. Upon being retained, we immediately lodged an appeal to the County Court and an appeal bail application and following that application the client was released on bail.
The appeal was listed sometime in the future and by the time the appeal came before the County Court, the first matter had been withdrawn.
The Charges
Drug Trafficking, Possess a Drug of Dependence and Possess Proceeds of Crime.
Appeal Results
Prior to the matter proceeding on appeal, we had the client in rehabilitation and when the matter came before the County Court Judge and following submissions, the client received a work only Community Corrections Order for 15 months with 200 hours of community service. It was an outstanding outcome.
