The current charges were invalid because they were not filed within the seven-day time limit set out in the legislation. The prosecution therefore, had to withdraw the charges against our client.

Summary offences must be filed within 12 months of the date of the offence, and therefore, the police had run out of time to initiate new charges for the offences, as 14 years had now passed.

Driving offences carry significant penalties if found guilty; Our client was very fortunate in this case as he avoided any finding of guilt or any penalty.

After lengthy plea submissions to the court, the Magistrate was satisfied that an immediate term of imprisonment would not be appropriate in the circumstances. The Magistrate ordered that the client be placed on a Community Correction Order for 12 months to undertake unpaid community work and engage in sex offender programs as directed by corrections.

A plea of guilty was entered to the charges, and following submissions, the court ordered that the client complete a 200-hour Community Correction Order over 12 months. Given the client’s age, lack of prior convictions, and cooperation with the police during the investigation, the Magistrate did not record a conviction against our client’s name.

This was an excellent outcome for the client, as he was able to avoid having a criminal conviction on his record.
