Trafficking Drug of Dependance section 71AC Drugs, Poisons and Controlled Substances Act 1981 (DPCS); Possess Drug of Dependance section 73 DPCS; Possess Proceeds of Crime section 195 Crimes Act 1958.
Facts
The client was a football player. His good mate had some ecstasy tablets that he wanted to get rid of, and the client said he would help him. He sold tablets on two occasions at a nightclub, and was caught by security guards with the money from the sale.
Results
The client made a full confessional Record of Interview. In hindsight this was a mistake as the police did not have a statement from the bouncer or the person that the client sold drugs to. However, ultimately the client received significant credit for assisting police. The client was asked to provide clean urine screens and a number of different character references. Following submissions, the Court ordered that the client complete a 200 hour Community Corrections Order over 12 months. There was no conviction.
