Driving Whilst Suspended section 30(1) of the Road Safety Act. Listed at the Frankston Magistrates Court.
Facts
The client was an aged care worker, who was required to drive as part of her job. The client was very committed to her job but unfortunately had been banned from driving in the state of Victoria for a period of three months, following a demerit points suspension. She had been making alternative travel arrangements whenever possible. However, occasionally she was unable to do so. In order to keep her job she drove her car, but was caught. Initially she told police that she was not aware she was suspended.
Results
We obtained extensive references in relation to her employment. We also sought instructions in relation to her knowledge of the suspension. Following submissions to the Court the client received a fine without conviction and one month off the road. It is not unusual in Victoria for people to be suspended for periods exceeding three months, so this was a good outcome.
