Infringement warrants, resulting from an accumulation of toll traffic infringements between Seaford & Noble Park listed in the Frankston Magistrates’ Court.
Facts
Our client was facing an accumulation of unpaid toll fines. She was arrested by the Sherriff and bailed to the Frankston Magistrates Court. The unpaid tolls related to a period of 2 years, during which our client believed she was maintaining a credit balance in her e-tag account. However, she was unaware that a family member was using another vehicle also registered in her name, and was accumulating the infringements in that vehicle. Once she became aware of this, our client applied to have the fines revoked, but this was refused.
Results
We then appeared on her behalf in the Frankston Magistrates Court. The court found that “special circumstances” existed, and our client was effectively discharged of her obligation to pay the full amount of $33 000 in fines and accumulated costs.
