Facts
The client was served with $30 714.20 worth of unpaid infringement warrants. The most likely outcome was that he would either begin a payment plan to pay the full amount in regular instalments, do a considerable amount of community service or serve up to two years in prison.
Results
After taking extensive instructions, we discovered that the client had provided his old car to his mother because he now used a company car belonging to his employer. His older brother, who had been a heroin addict for 20 years, had borrowed the car and incurred huge e-TAG fines.
After hearing evidence and listening to further submissions, the Magistrate was sympathetic to the client’s predicament and discharged all fines under section 160(3) of the Infringements Act.
This was an unusual but outstanding result for the client.
